What is Chapter 13 Bankruptcy?

Chapter 13 is also called a wage earner's plan. It permits individuals with reliable income to develop a plan to repay their debts in whole or at a discount. The repayment plan typically lasts from three to five years, with dischargeable debts being discharged at the end of the plan.

Some debts are exempt from discharge after completion of the repayment plan. These debts may include most tax debt, student loans and child support payments.

Who is eligible for Chapter 13?

Many of our clients who file for Chapter 13 have not met the requirements to file for Chapter 7 or have significant assets they wish to protect. For example, they may have equity in property that exceeds the exemption limit for Chapter 7 and want to save their home from foreclosure.
